RZECZPOSPOLITA POLSKA
MINISTER ROZWOJU I FINANSÓW W odpowiedzi na interpelację nr 5940, kierowaną do Ministra Finansów oraz Generalnego Inspektora Informacji Finansowej, złożoną przez Posła na Sejm RP – Pana Jana Szewczaka przedstawiam następujące stanowisko.
Ustawa o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu z dnia 16 listopada 2000 r. w brzmieniu z roku 2011 w art. 9f ust. 1 zabrania instytucji obowiązanej, będącej podmiotem świadczącym usługi finansowe nawiązywania i utrzymywania współpracy w ramach bankowości korespondencyjnej z bankiem fikcyjnym. W związku z powyższym zwracam się z następującym zapytaniem: Czy i w jakich latach działający w Polsce mBank, którego właścicielem jest niemiecki bank Commerzbank był bankiem korespondentem dla firm działających pod nazwą:
* Breder Suasso;
* Global Transactions Services;
* Global Transactions LLC,
* Global Transatlantic Solutions LLC,
* Global Transaction Services LTD,
* Global Transaction Management LLC, GTS;
* E-Transfer Technologies (ETT Software),
* Atlantix Global System LLC;
* Alternative Informacion System INC

i jakie świadczył usługi na rzecz tych firm? Generalny Inspektor Informacji Finansowej w toku kontroli wypełniania przez BRE Bank S.A. - poprzednika prawnego mBank S.A. obowiązków w zakresie przeciwdziałania praniu pieniędzy oraz finansowaniu terroryzmu przeprowadzonej w 2010 r. nie stwierdził naruszenia przez ten podmiot, określonego w art. 9f ust. 1 ustawy z dnia 16 listopada 2000 r. o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu (Dz.U. z 2016 r., poz. 299 ) - dalej jako ustawa, 2 zakazu utrzymywania współpracy w ramach bankowości korespondencyjnej z bankiem fikcyjnym. Jednocześnie informuję, że informacje o transakcjach zgromadzone w Systemie Teleinformatycznym Generalnego Inspektora Informacji Finansowej (SI*GIIF), które mogłyby wskazywać na utrzymywanie przez przekazującą te informacje instytucję obowiązaną współpracy w ramach bankowości korespondencyjnej z określonymi podmiotami, objęte są tajemnicą bankową. Zasady dotyczące ochrony i udostępniania danych zgromadzonych przez Generalnego Inspektora Informacji Finansowej określa Rozdział 7 ustawy. Zgodnie z art. 33 ust. 4 ustawy informacje objęte tajemnicą bankową Generalny Inspektor Informacji Finansowej udostępnia i przekazuje organom, o których mowa w art. 33 ust. 2 ustawy, zgodnie z zakresem upoważnień i trybem określonym w ustawie z dnia 29 sierpnia 1997 r. – Prawo bankowe (Dz. U. z 2015 r., poz. 128). Oznacza to, iż będące w posiadaniu Generalnego Inspektora Informacji Finansowej informacje objęte tajemnicą bankową mogą być udostępnione lub przekazane wyłącznie podmiotom wskazanym zarówno w art. 33 ust. 2 ustawy, jak i art. 105 ust. 1 Prawa bankowego.
